Terms of Service.

The terms governing your engagement of PropDefect for defect inspection services in Singapore. Plain language, Singapore law.

1. About these terms

These Terms of Service (“Terms”) govern your engagement of PropDefect for property defect inspection services in Singapore. By booking an inspection, communicating via WhatsApp, or otherwise engaging our services, you accept these Terms.

If you do not agree with any part of these Terms, please do not engage our services.

2. The services we provide

PropDefect provides independent property defect inspection services for Singapore residential property, including but not limited to:

  • HDB BTO defect inspection (at or shortly after key collection)
  • Executive Condominium and private condominium handover inspection
  • Landed property defect inspection
  • Pre-renovation, post-renovation, and tenancy baseline inspections
  • Defect report preparation in the format required by your developer or HDB BSC
  • Continued WhatsApp consultation throughout your Defect Liability Period

Specific scope is defined by the inspection package you book (Essential, Comprehensive, or Post-Reno). We reserve the right to refuse or terminate any engagement where the property type, location, or scope is outside our operational capability.

3. Booking and confirmation

Bookings are made via WhatsApp or email. A booking is confirmed only once we have responded confirming a date, time, and inspection scope. You will receive a written confirmation (WhatsApp message or email) with the agreed appointment details.

You are responsible for ensuring access to the property at the scheduled time. We will arrive within 15 minutes of the agreed start time, traffic and weather permitting.

4. Pricing and payment

Our fixed prices are published on our full pricing page. The applicable package and final price are confirmed at booking. We charge in Singapore Dollars (SGD) and accept PayNow, bank transfer, and credit card via our payment provider.

Unless otherwise agreed in writing, payment is due within seven days of inspection completion or upon delivery of the defect report, whichever is earlier. Late payments may attract a reasonable administration charge.

Pricing for landed properties, Good Class Bungalows, and inspections of unusual scope is provided on consultation and confirmed in writing before any work begins.

5. Cancellation and rescheduling

  • More than 48 hours before the appointment: no charge, full reschedule available.
  • Within 48 hours of the appointment: a rescheduling fee of up to 30% of the booked package may apply, at our discretion.
  • No-show or refused access on inspection day: full booked package is payable.
  • Cancellation by PropDefect: if we cancel for any reason, we will refund any payment in full and offer the next available slot at no rescheduling fee.

6. Inspection scope and limitations

Our inspections cover the systems and items defined in the booked package and on our What We Check page at the time of booking. We perform visual, tactile, and calibrated-tool-based inspection within the unit. We do not:

  • Conduct destructive testing (e.g., breaking walls, lifting tiles, opening sealed cavities).
  • Inspect structural elements beyond visual examination. Severe structural concerns require a separate structural engineer.
  • Inspect or warrant the condition of common-area elements outside your unit boundary.
  • Provide legal advice on disputes with developers, contractors, or HDB. We provide factual reports that can be used by you or your legal advisor.

7. Defect reports

We produce defect reports in your developer’s or HDB’s required format. Reports are based on conditions observed at the time of inspection. We do not guarantee discovery of every defect. Some defects emerge only under specific conditions (use, weather, time) and may not be visible at inspection.

You are responsible for submitting the defect report to the relevant party (your developer, the HDB BSC, or as authorised). On Comprehensive and Post-Reno packages, we prepare and walk you through submission, but you remain the signatory and contractual party.

Status of the report. Our report and any documentation we produce are provided for your reference, to help you identify defects and pursue rectification with the responsible party. They record what our inspector observed at the time of inspection. They are not a legal determination of fault, liability, or the obligations of your developer, contractor, HDB, a vendor, or any other party, and they are not a substitute for professional structural or legal advice. Any decision or action you take using the report is yours alone.

For your use only. The report is prepared for you, the client. No other party may rely on it, and PropDefect accepts no liability to any third party who does. You may share the report with your developer, contractor, the HDB BSC, your legal advisor, or a future buyer for the purpose of rectification or sale, but doing so does not entitle them to rely on it as against PropDefect.

No representation or publication. PropDefect is not a party to any dispute, negotiation, or proceeding between you and a third party, and is not responsible for its outcome. Our name, reports, photographs, and materials may not be published, quoted, broadcast, or attributed in any media, marketing, or public forum without our prior written consent. PropDefect will not be named or represented as a party, expert, or witness in any proceeding unless separately agreed in writing. Where expert input or testimony is required, it is a separate engagement on separate terms.

8. Intellectual property

Defect reports, photographs, methodology, checklists, and any custom analysis we provide are licensed to you for your own use in pursuing rectification, dispute resolution, or sale of your property. They remain PropDefect’s intellectual property.

You may share reports with your developer, contractor, BSC, legal advisor, or future buyer. You may not republish PropDefect’s reports, methodology, or commercial materials publicly without our prior written consent.

Website content, the Toolkit, journal articles, and any free resources are provided under no licence beyond personal viewing and the embedded links. Bulk scraping, AI training on our content, or commercial republishing is not permitted without consent.

9. Disclaimers

Inspection findings are observations made by an experienced inspector at a specific moment. They are not warranties of property condition.

Information provided on our website, including the Toolkit, FAQ, and journal articles, is general guidance, not personalised advice. Always confirm specific matters with the relevant Singapore authority (HDB, BCA, SCDF, IRAS) or a qualified professional for your situation.

The free checklist app. Our self-guided inspection app (at app.propdefect.com) is a free tool that helps you carry out your own visual check against common defect points. It is a guide, not a professional inspection: it does not involve a PropDefect inspector, calibrated equipment, or an independent report, and it does not guarantee that every defect is found. Any checklist or report you generate with it records your own observations, not ours. For a credentialed inspection and an independent report, book a paid inspection.

Third-party links on our website are provided for reference. We are not responsible for the content of external websites.

10. Limitation of liability

To the maximum extent permitted by Singapore law:

  • Our total liability for any claim arising out of or in connection with our services is limited to the fee paid for the specific inspection engagement giving rise to the claim.
  • We are not liable for indirect, consequential, or special losses, including loss of profit, loss of opportunity, or loss caused by defects we did not identify due to their being undetectable at inspection.
  • Our report informs your own decisions. Any action you take, or choose not to take, based on it, including how you deal with your developer, contractor, HDB, or a future buyer, remains your responsibility.
  • Our inspection is non-invasive and not exhaustive. We are not liable for concealed, latent, or inaccessible conditions, or for defects not reasonably observable by the agreed inspection methods at the time. To the extent we are liable for any error, omission, or gap in a report, that liability is subject to the limit above.
  • Any claim relating to an inspection or report must be notified to us in writing within 12 months of the inspection date. After that, we have no further liability for that inspection, to the extent permitted by Singapore law.
  • Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud, or any other liability that cannot be excluded under Singapore law.

11. Your indemnity

You agree to indemnify PropDefect, and keep us indemnified, against any third-party claim, demand, loss, or reasonable expense (including legal costs) arising from: (a) your use, sharing, or republication of our report or materials beyond the licence in clause 8; (b) your breach of these Terms; (c) inaccurate, incomplete, or misleading information you gave us; (d) your engaging us to inspect a property you do not own or occupy without the owner’s authorisation; or (e) any third party’s reliance on or use of our report, documentation, photographs, or materials. This indemnity does not apply to any claim to the extent it results from our own negligence, wilful default, or fraud.

12. Confidentiality

We keep your inspection details, defect findings, and any identifying information confidential. We do not share with any third party except with your authorisation or as legally required. See our Privacy Policy for full data-handling detail.

Anonymised, aggregated insight from inspections (defect categories, frequencies by property type) may be used in journal articles, anonymised research, or service improvement, with no identifying details.

13. Governing law and disputes

These Terms are governed by the laws of Singapore. Any dispute arising in connection with these Terms or our services will, in the first instance, be addressed through good-faith discussion. If unresolved, disputes will be submitted to mediation through the Singapore Mediation Centre, and failing that, to the courts of Singapore.

14. Changes to these terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. For material changes affecting active engagements, we will notify you in writing. Continued use of our service after an update constitutes acceptance of the updated Terms.
